Introduction

Welcome to our online climbing coaching service (the "Service"). By using our Service, you agree to be bound by the following terms and conditions (the "Terms of Service"). If you do not agree to these Terms of Service, please do not use the Service.

Eligibility

The Service is intended for use by individuals who are 18 years of age or older. By using the Service, you represent and warrant that you are 18 years of age or older and that you have the legal capacity to enter into a binding agreement.

Service Description

Our Service provides individuals with access to experienced climbing coaches who will provide guidance, advice, and feedback on various aspects of climbing via direct message or email support. The Service includes personalized training plans or training recommendations, and regular check-ins with your coach. Responses to messages or emails will be provided within 72 hours, but we cannot guarantee a specific response time. We cannot promise any particular progression in a climber or training gains, but we will do our best to adjust and adapt to achieve optimal results.

Payment Information

The Service is provided on a 12-week minimum subscription basis, with different subscription options available. You will be required to provide a valid payment method when you sign up for the Service. Your subscription will automatically renew every 12 weeks unless you cancel your subscription, a minimum of 14 days’ notice is required before the next renewal date, see cancellation details below.

Cancellation

You have the right to cancel your subscription, without giving any reason. To cancel your subscription, you must contact us at kaizenclimbing@gmail.com, notice of cancellation must be given at least 14 days prior to the date of plan renewal. Any cancellation requests received less than 14 days in advance may not be processed in time, and the client will be responsible for payment of the subsequent plan.

Refund Policy

In accordance with UK laws on services, you have the right to a refund within 14 days of signing up for the Service. Please note that the cost of any work done by the coach, such as personalized training plans or video analysis, will be excluded from the refund. To request a refund, you must contact us at kaizenclimbing@gmail.com within 14 days of signing up for the Service.

Disclaimer of Warranties

Our Service is provided on an "as is" and "as available" basis. We make no representations or warranties of any kind, express or implied, as to the operation of the Service or the information, content, materials, or products included in the Service.

Limitation of Liability

In no event shall we be liable for any damages whatsoever, including but not limited to any direct, indirect, special, incidental, or consequential damages, arising out of or in connection with the use or inability to use the Service.

Indemnification

You agree to indemnify and hold us harmless from and against any and all claims, damages, costs, and expenses, including attorney's fees, arising from or related to your use of the Service.

Governing Law

These Terms of Service shall be governed by and construed in accordance with the laws of the United Kingdom, without giving effect to any principles of conflicts of law.

Changes to the Terms of Service

We reserve the right to make changes to these Terms of Service at any time. Any changes will be effective immediately upon posting to the Service. Your continued use of the Service following the posting of changes will constitute your acceptance of such changes.
